Tyler Perry was named the winner in a battle over the "What Would Jesus Do," trademark against Kimberly Kearney popularly known as "Poprah" from the VH1 series "I Want to Work for Diddy." The reality show personality claimed Perry stole her idea. 

The United States Patent and Trademark Office declared Perry the winner in a long battle over a "What Would Jesus Do" show.

Kearney made the case that she first used the mark in November 2007, and during the early stages of production, she "shared her television program and title with Tyler Perry Studios" and "not many months after sharing this program and soliciting [Perry] for financial support of this program, [Perry] filed to register this mark; consequently, eventually resulting in this cancellation proceeding."

Perry's attorneys however requested that Kearney admit to certain things. She had to admit that she had not produced a television show in connection with "What Would Jesus Do," as of yet and that she had not sold one, and or intended to do so.

Hollywoodreporter.com reported that the case was cancelled, "Because [Kearney] did not timely answer [Perry]'s Requests for Admission the facts included are deemed admitted and are "conclusively established,'" wrote administrative judges, "Despite Respondent's denials in her answer to [Perry's] petition, the deemed admissions supersede those denials and we are bound by them."

The judges noted Kearney's claims that Perry stole her "What Would Jesus Do" idea, but they said it was not enough, "these allegations are unsupported and we may not adduce any facts from them."

Perry is under obligation to actually use it in commerce "What Would Jesus Do" or he would have to abandon the mark.

In a desperate cry for help Kearney told her side of the story in a YouTube video and asked for help, "I'm pouring out my soul about this NIGHTMARE I've been going through trying to keep Tyler Perry from bullying me out of my tv show trademark for my show WHAT WOULD JESUS DO."
